New Investors’ Lease Law Extends Land Use to 99 Years, Spurs Jobs and Investments



MANILA – The newly amended Investors’ Lease Act is expected to attract more foreign investments and generate employment, particularly in agriculture, industry, and tourism, by extending the allowable lease of private lands to 99 years.

Republic Act (RA) 12252, signed by President Ferdinand R. Marcos Jr. on Sept. 3, 2025, amends the original 1993 law (RA 7652), which previously allowed a maximum of 50 years, renewable for another 25.

The measure provides a “flexible and dynamic policy” for foreign investors to establish industrial estates, factories, processing plants, agro-industrial projects, tourism ventures, ecological conservation initiatives, and other priority enterprises.

However, only investors with approved and registered projects under laws such as the Foreign Investments Act, the CREATE Act, and the CREATE More Act qualify for the extended lease term. Lease agreements must also be registered with the local Registry of Deeds.

Special Assistant to the President for Investment and Economic Affairs Frederick Go welcomed the reform, calling it a game-changer for competitiveness.
“For too long, we have lagged behind regional peers because of short-term land leases and restrictions. This law signals that the Philippines is ready for sustainable, long-term investments, which will translate to quality jobs and better opportunities for Filipinos,” Go said.

The amended law is positioned as a catalyst for agricultural modernization, industrialization, and technology transfer, reinforcing the administration’s vision of investment-led economic growth.
